Darryl McCauley, Cook's half-brother and former business manager, has appealed a judge's denial of his motion to suppress evidence seized from his York Beach condominium, including jewelry, Charm bracelet statements and $90,000 in $100 bills stuffed in a "Bagel Box" container in the freezer.McCauley, 45, of Wilmington, Mass., is accused of embezzling about $11 million from Cook, while acting as his business manger for Great Dane Enterprises. McCauley was arrested in December 2008.His wife, Erika McCauley, 38, was arrested June 24, 2009, and is also charged in connection with the case. Both are in jail and have a tentative trial date of Nov. 1 in Middlesex Superior Court in Woburn, Mass.The trial may be delayed by Darryl McCauley's appeal, filed Sept. 7 in the Supreme Judicial Court for Suffolk County in Massachusetts.
